Terms and Conditions

General

Letting Solutions’ detailed terms and conditions of service are set out in documents relating to the particular services being provided. These documents contain specific information on what is included in the service for the amounts stated. Specific terms and conditions of business are available for tenants, landlords with managed properties and landlords with unmanaged properties.

In the case of managed properties, a security deposit normally equivalent to one month’s rent is payable by the tenant, and is placed in a separate client account by Letting Solutions for the duration of the tenancy. No interest accruing in this account is payable to the tenant or the landlord.

Landlords and tenants are strongly advised to ensure that appropriate insurances are in place for tenancies. The availability of appropriate insurances is a condition of the availability of certain services from Letting Solutions.
Letting Solutions can advise on insurance cover and risk management services for landlords, available in association with Letsure. Letsure are insurance and risk management advisors to the lettings industry. Letting Solutions is an Appointed Representative of Lumley Letsure Limited who are authorised and regulated by the Financial Services Authority (FSA).

Landlords

Fees for landlords do not include costs which are properly the responsibility of the landlord such as maintenance work, repairs to the property, insurances or Council Tax when the property is not let. Landlords are separately invoiced for repairs and maintenance work commissioned on their authority.

It is the landlord’s responsibility to insure the property concerned appropriately and ensure compliance with:

· the requirements of lenders where the rental property concerned is the subject of a mortgage or other loan;

· all consumer protection legislation relating to furnishings and fire;

· smoke detectors legislation, including the fitting of appropriate fire detection alarms in the property;

· landlord registration requirements

· legislation and rules relating to Houses in Multiple Occupation ( HMO) if applicable. Landlords should ask the local Council for further advice as appropriate;

· all current UK tax legislation relating to the renting of property ( including in the case of landlords resident outwith the UK, the completion of the necessary documentation for submission by the landlord to the landlord’s taxation centre for agreement);

all Government and local authority safety and other regulations including initial provision and renewal of gas and electrical safety.

· any other legislation relevant to the letting of residential property.
Letting Solutions accepts no responsibility whatsoever for any issues related to the condition of a property prior to the commencement of any contracts with us, or for periods when a property is not covered by a current contract. It is the responsibility of the landlord to ensure that the property is fit to let prior to the commencement of the tenancy and during the period of the tenancy, subject to specific instructions issued in writing to Letting Solutions for any appropriate services.

We are happy to quote separately for any further individual services required in connection with a tenancy e.g maintenance work.

Tenants

An administration fee is payable by tenants when the paperwork for the tenancy is being set up. This fee is non refundable should the tenant or tenants withdraw from the tenancy, or if references are found to be unacceptable.

All tenancies are subject to the completion of a tenant assessment form and referencing. The availability of a tenancy cannot be assumed until receipt of satisfactory references and other required documentation, and agreement on a firm entry date to the property.
